IF YOU WORKED AS AN HOURLY STORE EMPLOYEE FOR A DOLLAR TREE STORE IN CALIFORNIA BETWEEN 2001 AND 2007, THERE IS A PENDING SETTLEMENT OF TWO CALIFORNIA CLASS ACTION LAWSUITS THAT AFFECT YOUR RIGHTS.
  • In 2003, a class action lawsuit was filed in Orange County Superior Court against Dollar Tree Stores, Inc. A second action, now consolidated with the first, was filed in May 2005. The actions have now been settled, subject to court approval.

  • The plaintiffs and Dollar Tree are finalizing their settlement agreement and hope to seek preliminary court approval in late November 2007.

  • The class action lawsuits sought unpaid wages and other damages resulting from claims that Dollar Tree did not adhere to California statutes and regulations concerning meal periods and rest periods.

  • Dollar Tree denied all of the allegations made in the complaints, and defended both actions aggressively.

  • Prior to any court determinations regarding class certification or the merits of the claims, the parties entered into an agreement to settle all claims on a class-wide basis. We believe the settlement is a fair compromise of the claims raised in the two class actions.

  • If the settlement is approved, every hourly store worker employed by Dollar Tree in California since January 2001 will be entitled to some compensation. These benefits affect assistant managers, sales associations and other hourly employees.
